Terms of Use

1. Parties and Acceptance

This User Agreement ("Agreement") is concluded electronically between HeyMom (the "Service Provider"), provider of the HeyMom mobile application ("App"), and the natural person end user ("User") who downloads, installs and uses the App.

Downloading the App, creating an account or using any feature means you have read, understood and accepted this Agreement and the Privacy Policy. If you do not accept, please do not use the App. This Agreement is governed by the laws of the Republic of Turkey.

2. Service Description and Scope

HeyMom is a mobile application that provides information, tracking, reminder and community tools for life periods such as pregnancy, the newborn period and the menstrual cycle, together with entertainment and AI-powered content.

• Weekly baby development and pregnancy tracking (including multiple pregnancy/twin support)
• Newborn feeding, sleep, diaper, growth, fever and vaccination tracking
• Menstrual cycle tracking and pregnancy planning mode (BBT, ovulation test logging)
• Doctor Journal and the "Ask Your Doctor" AI feature
• AI information assistants (text chat and topic-based assistants)
• AI visual analysis: lab/test result analysis, stool analysis, ultrasound commentary/gender prediction, baby face prediction, parent face matching
• Weekly AI summaries and the Health Report / health summary
• Memory Book and baby photo gallery (photos are stored on device only)
• Forum (TR/EN, pregnancy/newborn — 4 collections)
• Exercise sessions (breathing, Kegel), contraction timer, kick counter
• Family/partner link (father flow, shared dashboard, sharing preferences)
• Health trackers (water, vitamins, medication, blood pressure, weight, appointments, cravings, birth plan, postpartum)
• Home screen / lock screen widgets and an Apple Watch app
• Entertainment: horoscope, Chinese calendar, Rh gender prediction, celebrity matcher
• Push notifications, gamification, badges
• Premium subscription, promo/influencer discounts and referral
• Shopping links redirecting to third-party stores (e.g. Anne Pazarı)

HeyMom reserves the right to add, modify or remove features without prior notice.

3. Medical Disclaimer (Most Important Clause)

• Content does not replace medical advice, diagnosis, treatment or examinations
• AI assistants are not doctors, nurses, midwives, dietitians or other healthcare professionals
• AI Lab/Test Result Analysis, Stool Analysis, Ultrasound AI Commentary/gender prediction and other visual analysis features are NOT medical diagnostic tools
• Baby face prediction, parent face matching, horoscope, Chinese calendar and Rh gender prediction are purely for ENTERTAINMENT and have NO scientific validity
• "Ask Your Doctor" only provides question ideas for doctor visits; it does not replace medical appointments or online medical consultations
• None of the Premium features qualify as a medical service
• Always consult your physician for health-related decisions
• In emergencies call your local emergency number; do NOT use the App as an emergency tool

You acknowledge that you are solely responsible for any action, inaction or decision you take based on the App's information and features. HeyMom shall not be liable for any direct, indirect, medical, psychological, financial or moral damages.

4. AI and Visual Analysis Disclaimer

The App relies on cloud AI services, primarily Anthropic Claude API. By using AI features, you confirm:

• AI outputs are probabilistic and may be inaccurate, incomplete, outdated or misleading
• NO guarantee is given as to the accuracy, currency or fitness for purpose of AI outputs
• Questions, images and content sent to AI are your sole responsibility
• For visual analysis features, HeyMom gives no guarantee as to authenticity, medical validity or accuracy
• AI usage is subject to a credit/quota system (e.g. a weekly credit pool on the free tier, daily limits on Premium); quotas and credit rules may be set and changed unilaterally by HeyMom
• You may NOT use AI features to generate unlawful, violent, hateful, suicidal, child-exploitation or similar content

HeyMom is not liable for service outages, content policies or output quality of AI service providers (Anthropic, Google).

5. Account, Membership and Security

• Full use requires registration via email, Apple or Google
• Users under 18 may not use the App; data is not knowingly collected from anyone under 13
• You are solely responsible for the accuracy and security of your account
• You must not share your password
• You are responsible for all activity carried out via your account
• You can delete your account anytime via Profile > Privacy & Security > Delete My Account
• HeyMom may suspend or terminate accounts for fake accounts, impersonation or bot/script use
• You may not transfer or sell your account

6. Premium Subscription, Pricing and Cancellation

• Premium is offered monthly or annually
• A 3-day free trial may be available on the annual plan
• Subscriptions auto-renew unless canceled at least 24 hours before the renewal date
• Payment is charged to your Apple ID / App Store or Google Play account
• You can manage and cancel your subscription via the respective store settings
• Current prices are shown at the time of purchase on the in-app purchase screen and in the respective store (App Store / Google Play); they may vary by local currency and store policies
• Promo codes and influencer referral codes may offer special discounted packages; discount rates and conditions may be changed by HeyMom
• If the mother's account is Premium, the family-linked partner account may also benefit from ad-free use and AI access (family premium); this is not a transfer of the subscription and ends when the family link is dissolved
• Statutory withdrawal rights for online digital content are governed by Turkish Consumer Protection legislation; once you consent to immediate performance, the withdrawal right may be lost
• Refunds must be requested through Apple/Google policies; HeyMom cannot directly issue refunds
• Premium feature contents may change over time; features may be added or removed

7. Influencer Referral, Promotions and Campaigns

• The influencer referral system is referral-code-based
• Purchases made with a referral code use special discounted packages; discount rates may change
• Referral conversions and commissions are recorded server-side by HeyMom
• Trading, reselling, paid transfer to third parties or forging of codes is prohibited
• Physical product partnerships and QR code campaigns may be changed or terminated by HeyMom at any time
• HeyMom is not responsible for content, promises or misuse by influencers
• HeyMom may change program terms, commission rates and discounts or end the program

8. Community (Forum) Rules

• Do not share personal health information (ID numbers, medication dosages, lab results)
• Be respectful; insults, harassment, discrimination and hate speech are prohibited
• Do not provide medical advice; direct users to "consult your doctor"
• Advertising, spam, product/brand promotion and MLM content are prohibited
• Do not share copyrighted content without permission
• Sexual content, violence, content promoting suicide or self-harm is prohibited
• Misleading content such as fake pregnancy/newborn claims is prohibited
• Privacy violations (sharing others' photos, messages or identity without consent) are prohibited

In case of violation, HeyMom may remove content without prior notice, suspend or terminate the account. All forum content is the sole responsibility of the posting User.

9. Family/Partner Link

• You can establish a family link with a father/partner via an invite code
• Once the link is established, most tracking data is shared by default; intimate reproductive health data is off by default. Sharing items are managed from "Sharing Preferences" (details: Privacy Policy Section 6)
• Shared data may be displayed on the partner's phone, widgets and Apple Watch
• You are responsible for any data exposure from sharing the invite code with third parties
• The link may be dissolved anytime; shared data is deleted upon dissolution
• Unauthorized data viewing or misuse by a partner, or disputes between partners, are not HeyMom's responsibility; HeyMom does not mediate disputes

10. Prohibited Uses

• Any purpose contrary to Turkish or international law
• Infringing the rights of other users or third parties
• Reverse engineering, scraping, source extraction
• DoS/DDoS attempts
• Bypassing AI features, content filters or security mechanisms
• Unauthorized access to Premium features or payment system
• Forging or duplicating referral/promo codes
• Fake accounts, multiple accounts or bot use

HeyMom reserves the right to suspend, terminate and pursue legal remedies.

11. Intellectual Property

• App content (text, visuals, icons, design, code, brand, AI system prompts) belongs to HeyMom or it holds the relevant license
• Baby development data is compiled from expert and publicly available sources; composition rights are HeyMom's
• AI-generated responses are for personal, non-commercial use
• Unauthorized copying, distribution, derivative works or commercial use is prohibited
• For content you post in the App, you grant HeyMom a non-exclusive, worldwide, royalty-free, sublicensable license to display such content for the operation of the service

12. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available"
• No warranty is given that the App will be uninterrupted, error-free, virus-free, secure or timely
• Features requiring internet may have limited or no functionality offline
• No warranty is given for accuracy, completeness or currency of AI outputs
• HeyMom is not liable for outages, errors or policy changes of third-party services
• HeyMom is not liable for direct or indirect damages, loss of profit, data loss or reputational damage
• HeyMom's total liability is limited to subscription fees paid by the User in the 12 months preceding the claim
• Medical and AI disclaimers apply separately and absolutely

13. Indemnification

You agree to defend, indemnify and hold HeyMom harmless from all claims, lawsuits, costs, attorney fees and damages arising from your breach of this Agreement, unlawful use or content you share within the App.

14. Notices and Communication

• HeyMom may communicate via in-app notifications, registered email or push notifications
• HeyMom is not responsible for communication via channels other than the User's registered email

15. Amendments and Termination

• HeyMom may unilaterally update this Agreement
• Continued use after the updated Agreement enters into force constitutes acceptance
• You may terminate this Agreement anytime by deleting your account
• HeyMom may suspend or terminate App access in case of breach
• Upon termination, fees paid are subject to store policies

16. Force Majeure

Events beyond the parties' control such as natural disasters, epidemics, war, terrorism, cyber attacks, internet outages, third-party service failures and legal restrictions are deemed force majeure. HeyMom's obligations are suspended during the event.

17. Governing Law and Dispute Resolution

• This Agreement is governed by the laws of the Republic of Turkey
• Istanbul Courts and Enforcement Offices have jurisdiction
• Consumer Courts and Consumer Arbitration Committees retain jurisdiction for Users qualifying as consumers

18. Severability

If any provision is found invalid or unenforceable, only that provision is affected; the remaining provisions remain in full force and effect.
